Labour Ministry: Non-payment of 13th salary is a criminal offence

The Labour Ministry has issued an announcement warning employers that the 13th salary, whether it is paid under a collective agreement, personal contract or the business’ common practice, is part of an employee’s salary and failure to pay it is a violation of the Protection of Wages Laws.

It said non-payment of the 13th salary was therefore a criminal offence and the employer can be prosecuted.

The offence is punishable with a prison sentence of up to six months, a fine of up to €15,000; or both. The employer may also be ordered to pay the 13th salary owed.
